Good mental health is something that we all take for granted.

But there are many life events that can see us lapse into the unfortunate position of mental incapacity, leaving us vulnerable, alone and without help or support.

Appointing an attorney under a Lasting Power of Attorney (or LPA) to support your decision making during times of difficulty is essential as without an LPA you will only receive very limited (if indeed you receive any) support from the Court of Protection when medical and social services personnel seek to implement policy, costs driven decisions that directly affect your health and wellbeing; where financial decision making is concerned without an LPA you are further risking direct intervention by outside agencies in the future management of your personal finances.

If however, you are caught out before your situation can be managed more effectively by executing LPAs then it is vital that your loved ones seek competent professional legal advice as early as possible to secure a Deputy Order from the Court of Protection before outside agencies do so on your behalf based on their own policy, cost driven "best interests" grounds that pay little regard to your wish to provide a secure inheritance for your family and loved ones.

Lease Extensions

Lease Extensions

When you own a flat with a long lease, it’s easy to forget that you don’t own it outright. You are still a tenant and when the lease expires, the land goes back to the freeholder (landlord). Leases are a depreciating asset: the shorter the time remaining on your lease, the less valuable your property. For this reason it is imperative that you take action to extend your lease, if the lease is short, as many mortgage lenders are now insisting that such leases are extended before they will accept them as mortgage security. Extending the lease in these circumstances is obviously a matter of priority, it can help you sell or mortgage a leasehold property or get rid of ground rent payments and get the most out of your property. This can be a complex procedure with legal pitfalls – for both tenant and landlord – and there are strict deadlines to meet.

Residential long leaseholders have a legal right, in certain circumstances, to obtain a new lease (lease extension) for a price. We can advise on whether to extend your lease formally or informally (voluntarily or statutorily) and what you can expect in terms of legal fees and costs.

We recommend that you make contact with at the earliest opportunity to explore your options as the costs of extending a lease as the years on your lease decrease and lease extension cost increases.
